1. Our position, stated plainly
AGENCY 54, LLC does not sell personal information, and does not share personal information for cross-context behavioural advertising, as those terms are defined by the California Consumer Privacy Act as amended by the California Privacy Rights Act (CCPA/CPRA).
We have not sold or shared personal information in the preceding twelve months, and we do not have any present intention of doing so. We do not sell or share the personal information of consumers we know to be under 16 years of age.
Because we do not engage in these activities, there is nothing for you to opt out of. This page exists so that you can confirm that fact, and so that you can exercise the right in the event that our practices ever change.
2. What “sale” and “sharing” mean
Under the CCPA/CPRA, a “sale” is the disclosure of personal information to a third party for monetary or other valuable consideration. “Sharing” means disclosure for cross-context behavioural advertising, whether or not money changes hands.
Disclosures to service providers who process information solely on our behalf under a written contract — for example our payment processor, hosting provider or email delivery service — are neither a sale nor a sharing under the statute. Disclosures to a rail carrier that are necessary to create the reservation you asked us to make are likewise not a sale.
3. How to submit an opt-out request
Should you wish to submit a formal opt-out request notwithstanding the above, you may do so by any of the following methods. No account is required and we will not ask you to create one.

4. Opt-out preference signals
We honour Global Privacy Control (GPC) and comparable browser-based opt-out preference signals where our systems are able to detect them. If your browser transmits such a signal, we will treat it as a valid request to opt out of any sale or sharing of the personal information associated with that browser.
5. Authorised agents
You may designate an authorised agent to submit a request on your behalf. The agent must provide written permission signed by you, and we may contact you directly to verify that you authorised the request.
6. Response times
We will action a valid opt-out request within 15 business days of receipt and will confirm in writing. Opt-out requests do not require identity verification, though we may ask for enough information to link the request to the correct records.
7. Non-discrimination
We will not deny you services, charge you a different price, provide a different level or quality of service, or suggest that we will do any of those things because you exercised a privacy right. We do not operate any financial incentive programme tied to personal information.
8. Other privacy rights
California residents have additional rights of access, correction, deletion, portability and limitation of sensitive personal information. Those rights, and how to exercise them, are described in our California Privacy Notice and our Privacy Policy.
9. Residents of other states
Residents of Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, Nevada and other states with applicable privacy legislation may submit equivalent opt-out requests using the same contact methods above. We apply the same practice — we do not sell personal information — to every jurisdiction.
